Questions to be asked of the council at the December 4th meeting:
On September 27th of 2005 there was a special school election initiated by the WMRHS school board seeking public approval to transfer funds from the capital reserve budget to the budget for the expansion. Implicit in the school board's promise of no tax increase was the assurance that capital reserve projects would be canceled rather than merely refinanced.
Recent newspaper stories indicate that the school board does not intend to fulfil its legal responsibilities to cut spending under the terms of the approved 2005 voter referendum. As it is not within the legal discretion of the Board of Education to lie to the taxpayers, and voters, does the town council intended to take any action to ensure that this criminal conduct is properly investigated and prosecuted?

[The Mayor] I would make a very simple direct comment that this is totally outside the jurisdiction of the Borough Council... we are specifically prohibited by law to interfere with school board issues and we will not comment on that issue.

I am not blaming the Borough Council for the lies and crimes of the BOE... but I do think the Borough Council has a responsibility to use its substantial power to ensure that other branches of government do not abuse the public trust.
I frankly do not believe there is any state statute preventing the mayor and Borough Council from "interfering" by encouraging investigation, and if necessary prosecution, of illegal conduct of the Board of Education. In my opinion, by not acting, the council makes itself accomplice to lies and deception.
