HOLD HARMLESS AGREEMENT
FOR LOADING AND DELIVERY OF WOOD CHIPS/MULCH
Property Owner requests either the loading (into a vehicle owned by the Property Owner) or delivery of "material" consisting of wood chips/mulch and acknowledges that the Borough of Mendham makes no representations as to the content or safety of the material to be delivered. Property Owner is aware that such material has been collected as branches and brush material brought to the Borough Public Works Garage on Ironia Road by other property owners and may contain inorganic matter, seeds and other unknown materials.
IN CONSIDERATION of the Borough of Mendham's loading and/or delivery and dumping or placing the material on Property Owner's driveway, the Property Owner agrees to indemnify, defend and save harmless the Borough from and against any and all liability of any kind arising from the loading and/or dumping or placing of said material, including, but not limited to, environmental damage or contamination, damage to or filling of wetlands, adverse effects upon drainage, flood control, springs, streams or other water courses, water quantity or quality, erosion control, soil retention, vegetation, aesthetics or damage to known or unknown underground utilities, pipelines, facilities or structures of any kind.
It is expressly understood by the Property Owner that the Borough will deliver, if requested, the said material to a site designated by the Property Owner. In no event shall the Borough be responsible for the selection of the delivery site or for spreading, leveling, grading orother movement of said material.
The Borough's loading and/or delivery of said material is not to be construed as an acknowledgment by the Borough that the delivery or use of said material is permitted under local, state or federal laws, rules or regulations, nor shall it be construed as a waiver of the Borough's rights to enforce said laws, rules or regulations. The Property Owner acknowledges that it is the Property Owner's responsibility to obtain all necessary approvals, consents orauthorizations from all appropriate governmental agencies to permit the delivery or use of said material.
By signing this Agreement, the Property Owner agrees to be bound by the terms contained herein, and that those terms are identical to the terms outlined on the official form available on the Borough website as of 5/2005.

WOOD CHIP/ MULCH ORDER FORM
INSTRUCTIONS
The Borough will provide its residents with wood chip/mulch to residents for use at their
properties within the Borough.
DELIVERED WOOD CHIPS/MULCH
The Department of Public Works will deliver to any residence in the Borough wood
chip/mulch at a price of $25.00 per delivery. Each delivery shall consist of 3 to 4 yards
of material. Wood chips will be deposited on the driveway of the property only. Please
insure that the driveway is free of vehicles, bikes and other items.
To order delivered wood chips/mulch sign the attached form and indicate how many
loads you wish to purchase. You will be given a photo copy of the form which will serve
as your receipt. Please be sure to provide your day time phone number. A
representative of the Public Works Department will call you to schedule your delivery.
All deliveries will be made Monday through Friday, between the hours of 8:00 AM and
2:00 PM.
LOADED WOOD CHIPS/MULCH
Residents who have access to a pick up trucks or similar vehicles may have wood
chips/mulch loaded at the Public Works Garage on Ironia Road at a price of $10.00 a load.
Each load shall consist of 1 to 2 yards of material.
To order wood chips/mulch to be loaded on your vehicle sign the attached form and indicate
how many loads you wish. You will be given a photo copy of the form which will serve as your
receipt. You may take the form to the Public Works Garage, Monday through Friday, between
the hours of 8:00 AM and 2:00 PM.
