The Court's Conclusion (order):

We reverse the Board's denial of the variances and site plan approval, and we remand for the Board to grant forthwith the variance application and approve the site plan, pending successful completion of the 47 C.F.R. 11307(a)(4) environmental assessment process.

Quote:

..."The proposed site for the cell tower was located at the top of a 580-foot knoll near the center of the Route 24 coverage gap, on a 10.23 acre, privately owned lot, 255 feet wide by 1760 feet deep, in a sparsely populated R-1 zone. The property, which is heavily wooded and improved with a single-family residence, fronts on Route 24, but has ingress and egress through a gravel driveway connecting to Conifer Drive. Lower elevation residential lots surround the property. "...

...In response to comments from members of the public, the carriers revised the site plan changing the monopole to a 140-foot "tree" designed to resemble a white pine, with branches extending down beneath the existing tree cover; placing all equipment shelters and cabinets in a single building made to look like a barn; reducing the size of the facility to 4,600 square feet; surrounding it with an eight-foot board-on-board fence; and reducing the driveway to twenty feet with forty-three ten-foot evergreens planted along the edges for screening. ...

Funniest remark in the decision:

Quote:

The Board delayed its decision on the application for months by allowing lengthy, even repetitive and irrelevant testimony from the public.

Okay, so what that says...

Is there is a new cell tower going up on the 24 near Corey pending a payoff and a clear EIR? Just clarifying.

I think it is irresponsible of the town to throw away our money on this. We definatley need a cell tower. Let them put it up!!!!!
Obviously Mendham Twp is much better at wasing money than saving it. Why should they care how much it costs. If it were put to a vote, the people would vote in favor of the tower.

I wonder if the cell company would be willing to "disguise" the tower as a giant penis to remind the residents what they really got.

From Observer-Tribune
Brookside cell tower fight still simmers

...“There’s not much we can do on this,” Mayor Robert Pierson said Tuesday. “We’ve petitioned the Supreme Court for a hearing on the matter, but that’s our last real hope.”

He said it could take as long as six months for the Supreme Court to decide whether it will consider an appeal, but Verizon, the lead applicant in the matter, has promised not to obtain any construction permits until the township hears from the Supreme Court.

...If the tower is built, the mayor said the town has requested a blue-gray monopole, rather than one of the two alternate styles, which simulate either an enormous tree-like structure or a giant flagpole.

the only place that doesnt get reception is a small section of brookside.

cell tower = property decrease and interrupted signals of a similar frequency.

Many other places to build it.

there will be Zero impact on Property Values

Top of pagePrevious messageNext messageBottom of pageLink to this message   By Anonymous on Sunday, March 21, 2004 - 05:11 pm:

there will be a significant impact on property values. No one wants to move in with that in their backyard. The only place that I do not get reception is in a small section near the firehouse in brookside. If you don't get service, maybe you should have thought about that before getting a bad plan with a company that doesn't extend into a large portion of mendham.

oh well ... when we sell our house - we better knock off $50K because somebody's property has a cell tower hiddin in the middle of 10.23 acres

riiight anyway = got the tower no thanks you your complaint

my phone works fine, and actually it isn't sprint. Nice guess though.

More than 3 homes will be affected. Similar frequencies will be interrupted and therefore not work.

Everytime my phone works in mendham without the tower- i'll giggle and think of you.

Well for anyone who opposes the cell tower and actually uses one of the arguments that "they only lose coverage in certain areas" or that othey should use a different plan..I ask: so, where are the towers you connect to when you have reception? That's right - not in your backyard...the age old attitude. If you have a cell phone you should have no objections to a tower - unless they ask to put it in your kitchen (may get in the way). The only thing I would suggest is maybe get a little more creative in the whole..um..."tree camouflage" towers...is it me - or does it seem like the people desiging these things live in Florida? I wouldn't think it would be so hard to actually design a "tree" that looks like it belongs in this area..or at least give me a little ore of a chuckle when I do see one and just go ahead with a palm tree ;) But, I have no "complaints" about them..rather .. pretty darn humourous..maybe we could add a fake koloa bear up there and really throw everyone off!! Ha ha!!

Remember the good old days, BEFORE cell phones?
We all mangaed pretty darn good without them.
No yuppy bimbos doing the kamikaze in their SUV with a herd of "school tax inflaters" in the back seat taking curves on the wrong side of the road.
What really cracks me up is seeing "hubby" in the supermarket calling home to find out what aisle something is in. Jeez moron, exercise your fat ass a little and walk up to the courtesy counter and ask.
Cell phone towers should only be placed where they destroy the view of million dollar yuppie McMansions.

Top of pagePrevious messageNext messageBottom of pageLink to this message   By Anonymous on Wednesday, March 24, 2004 - 10:09 am:

Have you ever tried to ask someone where something is at the "supermarket"? (Super taking on a new meaning at our shopping center.) You ask nicely, say please and thank you, maybe an excuse me before asking, it's like you are committing a crime.

I think it's intelligent that a husband would call home to make sure he gets it right. Then he doesn't have to go twice.

I do agree about the yellow line kept on the left however. Scares the $hi! out of me when taking some curves. But, you forgot something. THE GLARE. This lady is always glaring at you like, she has every right to be in your lane pushing you into an arrow sign. Sometimes the tax inflators are as well. (The tax inflators... that's good)

Couldn't they put a cell tower in the chimneys on monster yellow house on cherry?

Cell tower fight goes to highest court

JULIE LANGE , Assistant Editor 04/15/2004

MENDHAM TWP - The legal dispute over a proposed cell tower on Conifer Drive is going all the way to the state%u2019s highest court.

On Wednesday, March 24, the Supreme Court decided it would review the Appellate Division%u2019s Jan. 29, 2003, decision, which ordered the township to grant a variance and site plan approval for a 148-foot cell tower on Conifer Drive.

At the Thursday, April 8, Zoning Board of Adjustment meeting, Board Chairman Richard Brusco said the case would not be argued before the Supreme Court until the fall, and a decision is not expected until spring 2005. "

Hmmmm, the sun sets in the WEST and every house EAST of the tower location is on a down slope, leaving possibly 1 house that might see the sunset and even that is doubtful. Fact is, it will be Morris Twp residents, if any, who get their sunset screwed, so what the hell!!
I think a cell tower in the shopping center would be nice too, since you can't get any service on that side of town, obviously because the cell companies have already reduced power off the existing cell towers in anticipation of the new one. Try your cell by Moro's, Verizon doesn't work.
Put a tower in the shopping center, disguise it as a 100 foot tall 60 year old Foodtown gang member.
