RESOLUTION #174-05
WHEREAS, Sharron Minard d/b/a Fabulous Fauxs has applied for a
sewer connection permit to allow for the re-occupancy of a retail shop in an
existing structure located on property designated as Lot 2 in Block 1501, which
is also known as 4 Hilltop Road. This structure was previously used as an
antique shop and is currently connected to the sewer collection system; and
WHEREAS, the re-occupancy of the existing structure as a fashion
jewelry store will not result in an increase in the sewerage flow generated by the
subject property; and
WHEREAS, the Borough Engineer, Paul Ferriero, P.E., has reviewed the
application, and has recommended the approval of the connection; and
WHEREAS, based upon the information submitted by the applicant under
date of October 3, 2005, the application meets the requirements of Subsection
168-47B(1)(b) of the Borough Code.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Mendham, in the County of Morris and State of New Jersey, that the
aforesaid application be approved, subject to the following: compliance with
Section 168-49 of the Borough Code, requiring replacement of all existing
fixtures with water-saving fixtures; the flow not exceeding 70 gpd; and Planning
Board approval, if required.
This Resolution shall take effect immediately, but the approval hereby
granted shall be subject to revocation if the flow standard as projected is
exceeded in actual use.

RESOLUTION #177-05
WHEREAS, Barbara J. Mason has made application for a sewer
connection permit for the expansion of an existing area presently utilized as a
fitness training business at Jockey Hollow Professional Park, 5 Cold Hill Road
South, Unit #16, Block 2701, Lot 5 . This structure is presently connected to the
sewer collection system and would continue to be used as a fitness training
center; and
WHEREAS, the proposed expansion will result in an increase of 30
gpd in the projected sewage flow; and
WHEREAS, the Borough Engineer, Paul Ferriero, P.E., has
reviewed the application, and has noted that it does not comply with Section 168-
47 of the Code of the Borough; and
WHEREAS, based upon the information submitted by the applicant
under date of October 18, 2005 and the Borough Engineer's review, the
application fails to meet the requirements of Subsection 168-47 (B)(1)(b) of the
Borough Code.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council
of the Borough of Mendham, in the County of Morris and State of New Jersey,
that the aforesaid application be denied.
This Resolution shall take effect immediately.

WHEREAS, the Mendham Borough Board of Education has filed a written
consent with the Borough of Mendham to have various traffic regulations be made
applicable to the semi-public roads, streets, driveways and parking lots at the
Hilltop School.
NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the
Borough of Mendham, in the County of Morris, and State of New Jersey, as follows:
SECTION 1. The following traffic regulations shall be made applicable at
Hilltop School:

No person shall stop or stand a vehicle upon

8. Violations/Penalties.
Unless another penalty is expressly provided for by the New Jersey statutes,
every person convicted of a violation of this ordinance or any supplement
thereto shall be liable to a penalty of not more than fifty dollars ($50) or
imprisonment for a term of not exceeding fifteen (15) days or both.
9. Signage.
All signs, posts or other necessary materials shall be installed and paid for
by the Mendham Board of Education. All signing shall conform to the
current Manual on Uniform Traffic Control Devices pursuant to N.J.S.A.
39:4-198 and N.J.S.A. 39:4-183.27.
SECTION 2. All ordinances of the Borough of Mendham which are
inconsistent with the provisions of this Ordinance, are hereby repealed to the extent
of such inconsistency.
SECTION 3. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be unconstitutional or invalid, such decision
shall not affect the remaining portions of this Ordinance.
SECTION 4. This Ordinance shall take effect upon publication and as
required by law and upon the posting of appropriate signs and upon approval of
the Commissioner of Transportation.

SUBJECT:
ADMINISTRATOR'S REPORT
The very short month of November has begun! Please remember that the Municipal
offices will be closed on Friday, November 11th in observance of Veterans' Day. I have
the following to report:
Item # 1 Ordinances:
Introductions. As we come down to the end of the year there are two ordinances
scheduled for introduction that have been pending for a very long time. Ordinances #31-
05 and #32-05 provide for traffic regulations at Hilltop School and the High School
respectively. These ordinances have been languishing at DOT for some time now and
have finally been approved for action by the governing body.
Public Hearing. The Bliss Road speed limit ordinance is on the agenda for public
hearing and possible adoption.
Item #2 Actions to Be Taken:
There are some routine matters on the consent agenda. Other action items include a
resolution authorizing the hiring of Jonathan Greenemeier to replace Bill Taquinto who
resigned from the Public Works Department. Also, as is the normal practice at this time
of year, Sue has prepared a resolution transferring funds from and to various accounts.
Item #3 Discussion Topics:
There are three items listed as discussion topics for Monday night. The first topic is the
return of Mariah Seminara from the Mendham Junior Women's Club. She has a follow
up on the information she presented several meeting ago on centennial flags. The second
topic is placed on the agenda at the request of Councilman Murphy who would like to
discuss participating in the cable television channel that has been organized by Mendham
Township. You will recall that Patriot Media provides both municipalities with a
Public/Educational/Government channel.
Item #3 Emergency Generator Installation:
Work has commenced at both the Firehouse and Police Headquarters.
Item # 4 Sidewalk Repairs:
A preconstruction meeting was held on Thursday, November 2nd. The contractor
informed the Borough that he could not start until after Thanksgiving. The Borough
Engineer's office will monitor the situation and will determine if weather or temperature
issues will prevent the work from commencing. The contractor estimates the work can
be completed in one to two weeks.
Item #5 Paving Jobs:
Milling and paving on Bockoven and Wedgewood Roads are complete.
Item #6 Recycling, Holiday Schedule:
As in previous years, the County will be placing roll-off containers at the public works
compound for residents to use during the week of Thanksgiving when there is no
curbside pickup. We will be issuing press releases and posting a notice on the Borough's
web site.
Item #7 Finance:
2006 Budget. Sue is preparing the 2006 budget worksheets, and we will be preparing a
draft budget by the first week in December. Instructions regarding 2006 salary
recommendations and capital budgets have been distributed to the appropriate staff.
Finance Committee Meeting. There is a committee meeting scheduled for Thursday,
November 17th at 6:30 PM with Bud Jones and Sue Giordano.
Morris County Joint Insurance Fund. Today I am meeting with a representative from the
Morris County Joint Insurance Fund. As I reported previously, the Borough has made an
application to the fund with the hope of being able to save some money. The
representative is interested in inspecting various Borough facilities and buildings.
Item #8 Personnel:
Committee Meeting. The Personnel Committee is meeting in the Phoenix House at 7:00
PM on Monday, November 7th to review resumes from prospective special counsel law
firms.
Item # 9 Land Use:
COAH. On Tuesday, November 8th I will be meeting with Paula DeBona, Adrian
Humbert and Sue Giordano to review the draft COAH spending plan prepared by Paula.
We need to plug in proposed spending and collection numbers as well as other
information.
Item #10 Deer Management:
A Deer Management meeting has been scheduled for Thursday, November 10th at 7:00
PM.
Item #11 Public Works:
New Truck. The new truck has been delivered. The vendor has asked if it can be taken to
the New Jersey League of Municipalities conference later this month to be displayed.
Item # 12 Public Safety Committee:
Committee Meetings. The committee met on Thursday, November 3rd to review various
items which the Chair will present to the governing body Monday night. A tentative
meeting with representatives from the high school has been scheduled for November 28th
to discuss the construction project. The Board's business administrator is confirming
their representatives' availability.
High School Gate. An issue has arisen regarding the gate between the high school
parking lot and Drake Road. The hinge on the gate has been broken for some time now.
Since the gate was custom made for that opening, a new hinge must be fabricated by the
welder used by the DPW. The welder was to complete the job last week but failed to
show up, and I have asked Tom to make this a priority. In the meantime, the DPW has
erected barricades to prevent traffic flow when a police officer is not present.
Item #13 Master Plan Review Committee:
Wastewater Management. Jim Wancho and I met recently with the Master Plan Review
committee to discuss the impact of the Wastewater Management Plan on the Master Plan.
A good part of the discuss centered around the sewer ban enacted by the Borough in the
1990s. At the request of the committee I went on a hunt gathering information regarding
those lots that were grandfathered when the ban was enacted. Using the existing service
list a comparison was made with the list of lots grandfather in to determine future hook-
ups. Our intern plotted the lots on a copy of the tax map, and it was reviewed by the
committee on Thursday night.
Traffic Engineer. You may have noticed the mechanical and human traffic counters in
the Borough this past week. It is my understanding that the traffic engineer's staff will be
counting traffic at the Kings Shopping Center this Saturday.
Item #14 Park & Go Grant:
Last month I completed and submitted to the Smart Growth, Office of State Planning, the
Park & Go grant application authorized by the governing body in October. This was the
first time an application for a grant was submitted electronically through the new SAGE
system at the Department of Community Affairs. If approved, the grant will fund a
parking study for the Historic Business District.
Item #15 - MASH Van & Parking Space:
I have been notified that the new van will be delivered by the end of this month. Also, at
the request of the Executive Director, Tom Miller has prepared a plan to create a new
parking space for the van. Tom believes that the parking space, needed due to the
increased size of the van, can be installed by the Public Works Department. It will entail
excavating some ground near the sidewalk leading to MASH's office and community
room , extending the sidewalk into the excavating area and re-painting the adjacent
parking spaces.
Item #16 Mendham Cooperative Nursery:
I recently met with representatives from the cooperative nursery who expressed a desired
to expand their playground and security fence. I would like to arrange a site meeting
with Tom Miller and the Public Works and Utilities committee to review their plans.
