ORDINANCE # 2 - 05
AN ORDINANCE OF THE BOROUGH OF MENDHAM,
COUNTY OF MORRIS, AND STATE OF NEW JERSEY
TO AMEND CHAPTER 124, LAND USE PROCEDURES
AND CHAPTER 195, SUBDIVISION OF LAND AND
SITE PLAN REVIEW, OF THE CODE OF THE
BOROUGH OF MENDHAM TO ADOPT AN
APPLICATION CHECKLIST
BE IT ORDAINED, by the Borough Council of the Borough of
Mendham, in the County of Morris, and State of New Jersey as follows:
SECTION 1. Chapter 124, Land Use Procedures, of the Code of the Borough
of Mendham is hereby amended in the following particulars only:
a.
Article I, Planning Board, Section 124-8, Procedure for filing applications,
is hereby amended to read as follows:
"§124-8. Procedure for filing applications.
Applications for development within the jurisdiction of the
Planning Board, pursuant to the provisions of P.L. 1975, c. 291
(N.J.S.A. 40:55D-1 et seq.), shall be filed with the Secretary of
the Planning Board. The applicant shall file, at least 35 days
before the date of the monthly meeting of the Board, 22 copies of
a sketch plat, 22 copies of an application for minor subdivision
approval, 22 copies of an application for major subdivision
approval or 22 copies of an application for site plan review,
conditional use approval or planned development. At the time of
filing the application, but in no event less than 35 days prior to the
date set for the hearing, the applicant shall also file 22 copies of
all plot plans, maps or other papers required by the Application
Checklist set forth as Appendix A of this chapter. The applicant
shall obtain all necessary forms from the Secretary of the
Planning Board. The Secretary of the Board shall inform the
applicant of the steps to be taken to initiate applications and of
the regular meeting dates of the Board."
b.
Article II, Zoning Board of Adjustment, Section 124-19, Appeals and
applications, Paragraph D, Incomplete application, is hereby amended in its entirety to
read as follows:
"§124-19. Completeness of application.
An appeal or application to the Board of Adjustment shall be
complete for purposes of commencing the applicable time period
for action by the Board of Adjustment when so certified by the
Board of Adjustment or its authorized designee. In the event that
the Board of Adjustment or its designee does not certify the
application to be complete within 45 days of the date of its
submission, the application shall be deemed complete upon
expiration of the forty-five day period for purposes of
commencing the applicable time period unless the application
lacks information in the form and substance required by the
Application Checklist set forth as Appendix A to Chapter 124, for
the particular type of application, which list of requirements and
forms shall be provided to the applicant, and the Board of
Adjustment or its designee has notified the applicant, in writing, of
the deficiencies in the application within 45 days of submission of
the application. The applicant may request that one or more of
the submission requirements be waived, in which event the
Board of Adjustment shall grant or deny the request within 45
days. Nothing herein shall be construed as diminishing the
applicant's obligation to prove in the application process that he
or she is entitled to approval of the application. The Board of
Adjustment may subsequently require correction of any
information found to be in error and submission of additional
information not specified in this part 1 or the Application Checklist
or any revisions in the accompanying documents as are
reasonably necessary to make an informed decision as to
whether the requirements necessary for approval of the
application for development have been met. The application
shall not be deemed incomplete for lack of any such additional
information or any revisions in the accompanying documents so
required by the Board of Adjustment."
c.
The Application Checklist, attached hereto as Exhibit A, is hereby
adopted and incorporated into the Code of the Borough of Mendham as Appendix A to
Chapter 124."
SECTION 2. Chapter 124, Land Use Procedures, Chapter 195, Subdivision of
Land and Site Plan Review, of the Code of the Borough of Mendham is hereby
amended in the following particulars only:
a.
Article V, Minor subdivisions, §195-12, Map requirements, is hereby
amended to read as follows:
"§195-12. Map requirements.
The application shall be accompanied by five copies of the
proposed subdivision. After determination of completeness by
the Technical Review Committee, an additional 15 or 20 copies,
as determined by the administrative officer, shall be presented.
The minor subdivision plat shall contain all of the information
required by the Application Checklist, Appendix A, Chapter 124."
b. Article VI, Preliminary Approval of Major subdivisions, §195-19, Preliminary
plat requirements, is hereby amended in its entirety to read as follows:
"§195-19. Preliminary plat requirements.
The application shall be accompanied by five copies of the
proposed subdivision. After determination of completeness by
the Technical Review Committee, an additional 15 or 20 copies,
as determined by the administrative officer, shall be presented.
The subdivision plat shall be in conformance with the Map Filing
Act, P.L. 1960, c. 141 (N.J.S.A. 46:23-9.9 et seq.) The
preliminary plat shall contain all of the information required by the
Application Checklist, Appendix A, Chapter 124."
c. Article VII, Final Approval of Major Subdivisions, §195-23, Final Plat
requirements, is hereby amended in its entirety to read as follows:
"§195-23. Final plat requirements.
A. The application shall be accompanied by an original cloth
tracing and 20 copies, plus any prints and reproducibles required
by the County Planning Board, of the proposed final subdivision.
The final plat shall have incorporated therein all changes or
modifications required by the approving authority in respect to the
preliminary plat.
B. The final plat shall be drawn in ink on tracing cloth and in
compliance with all of the provisions of the Map Filing Act, P.L.
1960, c. 141 (N.J.S.A. 46:23-9.9 et seq.). The size of the map
preferably shall be 24 inches by 36 inches. The final plat shall
contain or be accompanied by the information required by the
Application Checklist, Appendix A, Chapter 124."
d. Article IX, Site Plan Approval, §195-36, Procedure for preliminary approval,
Paragraph A, is hereby amended to read as follows:
"A. The applicant shall submit the preliminary site plan
application and five copies of plats and maps, together with the
information required by the Application Checklist, Appendix A,
Chapter 124, and payment of all required fees to the
administrative officer. After determination of completeness by the
Technical Review Committee, an additional 15 or 20 copies, as
determined by the administrative officer who shall submit copies
of said preliminary plat to the following:
(a) Approving

Chapter 124, and payment of all required fees to the

SECTION 3. All Ordinances of the Borough of Mendham, which are
inconsistent with the provisions of this Ordinance, are hereby repealed to the extent
of such inconsistency.
SECTION 4. If any section, subsection, sentence, clause of phrase of
this Ordinance is for any reason held to be unconstitutional or invalid, such
decision shall not affect the remaining portions of this Ordinance.
SECTION 5 . This Ordinance shall take effect immediately upon final
passage, approval, and publication as required by law.
SECTION 6. This Ordinance may be renumbered for codification
purposes.

RESOLUTION # 38-05
WHEREAS, the Borough Administrator contacted several employment
agencies with regard to hiring a temporary worker to work during the period of a full-time
employee's maternity leave; and
WHEREAS, Advantage Human Resourcing presented a candidate
satisfactory to the Borough for the temporary position in accordance with an employment
proposal, which proposal is attached hereto as Exhibit A; and
WHEREAS, the contract may be awarded without advertising for sealed public
bids since the amount of the contract is less than the bid threshold; and
WHEREAS, the Borough Council wishes to award a contract to Advantage
Human Resourcing, in accordance with the proposal attached hereto as Exhibit A.
WHEREAS, the Chief Financial Officer has certified that funds are available
for this purpose.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Borough Council
of the Borough of Mendham, in the County of Morris, and State of New Jersey, as follows:
1.
A contract for the hiring of a temporary worker for the period from
March 7, 2005 until July 11, 2005 is hereby awarded to Advantage Human Resourcing,
Parsippany, New Jersey, for $24.85 per hour, in accordance with the proposal dated
February 14, 2005, attached hereto as Exhibit A.

RESOLUTION #39-05
WHEREAS, First Morris Bank and Trust has made an application for a sewer
connection permit for the expansion of an existing structure on property designated as Lot 2
in Block 2701, which is also known as 95 East Main Street. This structure is presently used
as a bank and is currently connected to the sewer collection system; and
WHEREAS, the expansion will increase the facility by approximately 1,525
square feet to a total of 4,125 square feet and will add one urinal; and
WHEREAS, the Borough Engineer, Paul Ferriero, P.E., has reviewed the
application, and has noted that it does not comply with Section 168-47B of the Code of the
Borough since the expansion will result in an increase in design flow of 152.5 gpd for a total
design flow of 412.5 gpd; and
WHEREAS, the proposed use of the property is the same as the existing use
of the property, and Paul D. Fox, P. E., of Apgar Associates, represented that no additional
employees would use the expanded facility; that there would thus not be an increase in the
amount of flow generated from the site; that the two existing toilets would be replaced with
water-saving fixtures and that a low-flow urinal would be added to the men's bathroom and
that the projected flow would therefore decrease from the current actual flow of 72 gpd to 43
gpd; and
WHEREAS, based upon the information submitted by the applicant, the
Council is satisfied that it is in the best interests of the Borough to approve the application
pursuant to Subsection 168-47C of the Borough Code.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Mendham, in the County of Morris and State of New Jersey, that the aforesaid
application be approved, subject to the following: compliance with Section 168-49 of the
Borough Code, requiring replacement of all existing fixtures with water-saving fixtures and
requiring any new fixtures to be water conserving fixtures, including automatic shut-off sinks;
inspection by the Construction Official to confirm the installation of the water-saving fixtures;
the continued use of the facility as a bank, and for no other use, employing no more than
eight (8) full-time employees, or the equivalent thereof.
This Resolution shall take effect immediately, but the approval hereby granted
shall be subject to revocation if the new flow exceeds the current flow.

RESOLUTION #40-05
WHEREAS, the Borough of Mendham requires the services of a certified testing
laboratory to perform Acute and Chronic Bioassay testing of effluent from the Borough's
Sewage Treatment Plant as required by the New Jersey Department of Environmental
Protection for the period March 1, 2005 through February 28, 2006; and
WHEREAS, in response to a request for quotations, QC Inc. of 1205 Industrial
Highway, P.O. Box 514, Southampton, PA 18966-0514 submitted a proposal to provide
these services, including all sampling and sample transport, and
WHEREAS, the quotation submitted by QC Inc. was the lowest quotation received
which met the specifications; and
WHEREAS, this contract may be authorized without formal bidding because the
annual cost is less than the mandatory bid threshold; and
WHEREAS, funds have been certified as available for this purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Mendham, in the County of Morris and State of New Jersey, as follows:
1.
The contract for Acute and Chronic Bioassay testing is hereby awarded to QC
Inc., 1205 Industrial Highway, P.O. Box 514, Southampton, PA 18966-0514 for the period
March 1, 2005 through February 28, 2006 at a total cost not to exceed $9,320.00.
2.
All municipal officials are hereby authorized to take whatever actions may be
necessary to implement the terms of this Resolution.
3.
This Resolution shall take effect immediately.

RESOLUTION #42-05
WHEREAS, Pia Hamlin has applied for a sewer connection permit to allow for the re-
occupancy of a retail store in an existing structure located on property designated as Lot 41
in Block 1501, which is also known as 6 Hilltop Road. This structure was previously used for
retail purposes (Xanadu) and is currently connected to the sewer collection system; and
WHEREAS, the re-occupancy of the existing structure as a retail store will not result
in an increase in the sewerage flow generated by the subject property; and
WHEREAS, the Borough Engineer, Paul Ferriero, P.E., has reviewed the application,
and has recommended the approval of the connection; and
WHEREAS, based upon the information submitted by the applicant under date of
February 7, 2005, the application meets the requirements of Subsection 168-47B(1)(b) of the
Borough Code.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of
Mendham, in the County of Morris and State of New Jersey, that the aforesaid application be
approved, subject to the following: compliance with Section 168-49 of the Borough Code
requiring water-saving fixtures; the flow not exceeding 61.2 gpd; and Planning Board
approval, if required.
BE IT FURTHER RESOLVED that Resolution 174-04, which granted this same
applicant sewer connection approval for different space in the same structures (266 square
feet previously occupied by The Stained Glass Window) be and the same is hereby
rescinded.
This Resolution shall take effect immediately, but the approval hereby granted shall
be subject to revocation if the flow standard as projected is exceeded in actual use.

BE IT RESOLVED by the Mayor and Council of the Borough of
Mendham, in the County of Morris and State of New Jersey as follows:
WHEREAS, it is necessary for the Mayor and Council of the Borough of
Mendham to discuss matters relating to Personnel and Land Acquisition which matters
are permitted by Section 7.b. of the Open Public Meetings Act (Chapter 231 of the
Public Laws of the State of New Jersey for 1975) to be discussed in closed session in
the absence of the public; and
WHEREAS, the Mayor and Council of the Borough of Mendham has
determined that it is necessary in the public interest that the matters in fact be
discussed in closed session, and has estimated that, as nearly as can now be
ascertained, the results of the discussion can be disclosed to the public at the following
time and under the following circumstances: when the matters are resolved
NOW, THEREFORE IT IS RESOLVED that the public be excluded from
the ensuing portion of this meeting, during which only the aforestated matters will be
discussed.

ADMINISTRATOR'S REPORT
Please remember that the Borough Council meeting is schedule for Tuesday, February 22nd
and the Municipal Offices will be closed on Monday, February 21st in observance of the
President's Day holiday. I have the following items to report:
Item #1 2005 Budget:
Committee Meetings, Schedule. The Recreation, Land Use and Personnel Committees have
held their budget meetings. The Finance Committee is scheduled to hold their meeting on
Tuesday, February 22nd at 6:30 PM at the Phoenix House. A second Finance Committee
meeting will be scheduled for the beginning of March. I anticipate scheduling a review of the
budget by the full Council at the second meeting in March with the hope of introduction in
April.
CAP Restrictions. I recently attended a 2005 Fiscal Update workshop sponsored by the
League of Municipalities. One area of great concern and discussion is the new CAP law
which was adopted by the State last year. You will recall that under the old CAP law, the
State set the rate at which a municipal government could increase expenditures, expressed in a
percentage. You may also recall that certain expenditures were "outside" of the CAP such a
capital expenses, municipal court, certain insurance and financial aid to libraries. Capital is
still outside of the CAP. All of these items are now back under the CAP. Even more difficult
is a new formula being used to calculate the rate of growth for municipal expenses. This
year's CAP is 2.5%. The Borough can raise the CAP percentage by a 1% for a total of 3.5%
by adopting an ordinance. The good news if that the new CAP law allows the Borough to
utilize CAP amounts banked in 2003 and 2004. Banked CAP is the difference between the
actual expenses for those years and the CAP ceiling for those years. Previous years CAP
were around four or five percent. Bud Jones advises that this amount is approximately
$165,000 which can be added to the 3.5% CAP. The real problem will occur in 2006 when
the Borough will not have the ability to use any banked CAP. Therefore, it may be in the
Borough's best interest to insure that certain expenditures normally placed in the capital
budget (replacement computers, certain improvement projects) are placed in the operating
budget. This would insure an expanded base for 2006; however, it would also have an impact
on the 2005 tax rate. As they say, for every action, there is an equal and opposite reaction...
Master Plan & Revaluation Funding. During the Land Use Committee budget meeting a
significant amount of the discussion centered on the expenses related to revising the Master
Plan. Rather then funding the revision through the operating budget, the Borough has the
option of using a "special emergency appropriation" ordinance to spread the cost over a five-
year period. The Borough can use the same approach for funding the revaluation this year.
Bud Jones advises that these ordinances should be introduced after the budget is introduced.
Item #2 - Revaluation:
Good news from Fred Semrau. Realty Appraisal Company has agreed to conduct the
revaluation this year. You will recall that Borough awarded a contract with RAC last year,
but the project never started due to delays in approving the Borough's tax maps by the State.
Although RAC proposes a fee of $183,500, which is a twenty thousand dollar increase over
their previous fee, the cost is still very reasonable in comparison to other fees being paid by
municipalities. Fred has spoken with our Tax Assessor who agrees with us that the Borough
should move forward with re-authorizing the contract. It is my understanding that Fred
Semrau is preparing a resolution for your consideration Tuesday night.
Item #3 Emergency Rapid Notification System:
I spoke with Keith Heimburg of the County's Office of Emergency Management. Mr.
Heimburg informed me that the telephone notification system in use is available to the
municipality at no cost. He suggested that if the Borough wished to have any other official, in
addition to police, fire and OEM officials, to have authorization to use the system that a letter
be forwarded to his attention. Additionally, he informed me that if the Borough wished to use
the system to broadcast a non-emergency message, such as a special meeting, a fee of
approximately sixteen cents per call is charged.
Item #4 PAIC Fund Meeting:
I will be attending the annual reorganization meeting of the PAIC Fund on the morning of
Tuesday, February 22nd at the Mansfield Township municipal building.
Item #5 Morris County Improvement Authority:
The County and Improvement Authority have created a capital lease program that is available
to all municipalities. The minimum lease amount is $25,000. I will keep this information on
file in the event that the Borough wishes to avail itself of this program.
Item #6 Personnel:
Public Works. A resolution authorizing the hiring of a new employee in the Parks
Department is on Tuesday night's agenda.
Maternity Leave. Also on Tuesday night's agenda is a resolution authorizing an agreement
with Advantage Human Resources. On Monday, February 14th Karen Bellamy-Orgera
interviewed two temps from the firm to fill in while Karen is on maternity leave. We have
selected one temp worker and are recommending the Borough enter into a contract with the
company. The plan is for the temp worker to come in half days before Karen leaves for her
unpaid leave and continue until she returns in July.
Item #7 -Recycling:
I recently obtained from a colleague in Bergen County a set of bid specifications for curbside
collection of recyclable materials. As you may recall the Borough entered into a contract with
the Morris County MUA for collection of recyclables. In 2005 the Borough will be paying
the MUS a total of $2,055.00 per pickup, or an approximate total of $51,275.00. In past
years the Borough has had issues with missed pickup dates due to holidays falling on
Thursdays. I would like permission to solicit bids for 2006 later this year.
Item #8 Metcalf & Eddy Professional Services Contract:
You will recall that the engineering firm Metcalf & Eddy was hired last year to design and
oversee the construction of improvements at the water reclamation facility. It is now
necessary to amend and extend their contract. I have taken the liberty of inviting M&E Vice
President Tim Bradley to the March 7th meeting to update the governing body on the project,
discuss the contract amendment, and the permit issues related to the project.
Item #9 Mendham Borough Historical Society:
Please note Mr. Topping's February 2nd letter which is attached. He proposes that the Society
and the Borough host a coordinated "open house" to showcase the Phoenix House restoration.
If the governing body concurs, I will work with Mr. Topping on the event.
