Dear Mr. Mosher:

I have reviewed your voice mail message of Thursday, September 25. Please be advised as to the following. The Borough currently does not own tape-duplicating equipment. In order for the Municipal Clerk to duplicate a tape recording of a meeting she literally needs to play the tape in a quiet room while another device records the audio.

As I know you are aware, the Open Public Records Act requires a municipality to provide copies of records within a reasonable time. In light of the Borough's current limitation a two week period to produce a copy of a meeting tape is, I am sure you would agree, a reasonable time.

It is anticipated that the 2004 budget will allow for the purchase of updated recording devices, including duplication devices which will enable the Municipal Clerk to provide you with copies of recordings in a more expedient manner. Until that time, the Borough will endeavor to fulfill your request as Ms. Jones indicated in her 9/24/03 response. Very iruiy yours,
