Mr. Mosher,
Enclosed please find copies of the audiotapes from the August 18 and September 2, 2003 Borough Council meetings.
Also enclosed is a Records Request form for you to complete listing requests for all future copies. Although audiotapes of Council Meetings may be made available prior to the approval of written transcripts, they are still governed by the Open Public Records Act as a Government Record (see below) and as such, the requirement of a formal request is to be met.
- "Government record" or "record" means any paper, written or printed book, document, drawing, map, plan, photograph, microfilm, data processed or image processed document, information stored or maintained electronically or by sound-recording or in a similar device, or any copy thereof, that has been made, maintained or kept on file in the course of his or its official business by any officer, commission, agency or authority of the State or of any political subdivision thereof, including subordinate boards thereof, or that has been received in the course of his or its official business by any such officer, commission, agency, or authority of the State or of any political subdivision thereof, including subordinate boards thereof. The terms shall not include inter-agency or intra-agency advisory, consultative, or deliberative material, (excerpt from the Open Public Records Act P.L. 2001, Chapter 404 N.J.S. 47:A-1 etseq.)
Upon receipt of the formal request I will provide you with a timeframe in which the recordings will be provided. Please include in your request the fact that you will provide the blank audiocassette tapes.
