"public comment" question for the June 5th meeting.

In a clear effort to evade accountability for passing legislation that violates federal law, including constitutional protections, the council has refused to provide a straightforward answer to questions regarding their understanding, of their legal responsibilities in producing a local "public access" cable television channel. Typical of the legislatures hypocrisy you seem determined to use deliberate ignorance as an excuse for breaking the law-- perhaps a judge you have dinner with will see justice in that hypocrisy, but I would advise that a jury of citizens might see your contempt for the citizens' rights under the American Constitution very differently.

I have publicly requested, a publicly accountable statement from the council defining and defending their understanding (acquired through whatever guidance) of Federal Law relevant to the regulation of cable television and franchise agreements. In the effort to create an explicitly clear evidence record, I again publicly ask the council to publicly explain their understanding--acquired through whatever research, consultations, and guidance-- of federal law relevant to the regulation of cable television and franchise agreements... and most specifically relevant to the control/censorship of content. (USC 47 : 531)

I would venture a guess that the Mayor and Council will have to wait for an opinion from their crack legal firm, "Dewey, Bangor & Muffdiver".

The mayor answered:

quote:

My answer comes back exactly the same as the previous answer... we will consult with a council under specific situations .... censorship, what control, will be guided by the federal law, unless there's a specific circumstance to be judged it's hard to answer the question.

I guess I will have to ask the question a fifth time.
