It would appear that Patriot Media is resigned to losing the argument on its motion to dismiss, as they have chosen not to counter my argument with any reply. The return date for the motion (time limit for submission of papers) was December 11th. In state court it seemed usual practice for judges to decide motions on the "return date" but that hasn't been my experience in federal court. I am assuming the judge is going decide all the pending motions on one date in the not too distant future. Although I have learned not have any reasonable expectations regarding what a judge will do, it would be, I think, "unprecedented" for the court to reject a unanswered/unrefuted argument opposing expedient dismissal. Maybe, if I'm guessing right, after the holiday season Patriot Media will be willing to talk settlement Turkey.

Dave Murphy advised that he and Ralph had met with Gail Bain and she would be recommended for appointment to the Board by the Borough Council at their November 6 meeting. Daryl suggested in the interest of balance that upon her appointment, Gail be appointed Vice Chair of the Board. The Board agreed.

Steve Mountain volunteered to take on the role of Secretary. The Board agreed.

Daryl Brewster led a discussion on the appointment of Associate Members to the Board. He suggested that all current associates continue in their position. These individuals include:

Tom Kelly, Township At-Large
Gail Mooney, Township At Large
Buzzy Thomas, Township Recreation
Gary Russell, Township Recreation
Larry Paragano, Township K-8 Board of Education
Bob Cleary, Borough At-Large

Dave Murphy indicated that he would follow-up with the Borough K-8 Board of Education, the Borough Recreation Committee, and Regional High School to ask for
associate representatives from those groups. Steve Mountain volunteered to put together a description of associate representative responsibilities for the next board meeting.

Daryl led a discussion on the Board meeting schedule. It was suggested that the Board meet on an every other month schedule, beginning in January 2006. Sub-committees can and should meet more regularly. The Board unanimously agreed with this recommendation.

The Board reviewed the goals and objectives for the coming year. Steve Mountain and
Ralph Blakeslee agreed to put together a draft of the Board's 2007 budget for review by the full Board. Steve and Ralph also agreed to work on a draft Policy and Procedures manual for the station. Steve indicated that additional oversight is needed for the paid station manager. It was suggested Bob Cleary might be able to provide such oversight.
Ralph and Steve agreed to meet with Bob to discuss. It was agreed that the discussion of program development, and equipment acquisition should be carried until the next meeting when more of the station volunteers were present.

Daryl led a discussion on sponsorship and advertising activities. He summarized to date the efforts in this area and the plan for attracting additional sponsors/advertisers. Ralph Blakeslee agreed to revise the sponsorship and advertising letter/form for the next meeting. Dave Murphy agreed to take the information back to the Mendham Business Association.

With no further business to iscuss, the meeting was adjourned at 9:05 a.m.

The Board engaged in a discussion of the organization of the Station's management structure. It was suggested by Steve Mountain that the Board consider the creation of a general management position (part-time) to oversee the week to week operation of the station. Steve proposed the position could be responsible for the management of the station's technical assistant (Devin Staples), as well as for the station's administrative needs (program management, equipment ordering/installation, sponsorship/advertising, and general support for the TV-25 Board). Steve proposed that the position could be 5-10 hours per week to start, but could grow to a larger time commitment as the station's needs grow and as advertising revenues increase. The salary would be offset by advertising revenues.

After a discussion of the proposal, the Board approved the concept and authorized Steve/Ralph to proceed with a search for the position.

Ralph Blakcslee reported that the Borough Council had approved the appointment of Geri Bain to the Board and that she would be in attendance at the next meeting.

With no further business to discuss, the meeting was adjourned at 8:55 a.m.

Hard to find $22 worth of video information and entertainment on Channel 25 ... let alone $22,000 worth.

As I've pointed out the whole idea of "sponsorships" is plainly illegal. I think if they can actually sell $7,000 worth of these, Patriot Media will finally fulfil its legal responsibility under federal law to inform the Mendham's of their legal responsibilities in operating a public access channel (ie. Patriot media will see the lost advertising revenue and realize it better put a stop to this). PEG access was established as a "public service" and is regulated by federal law. By illegally commercializing, and unconstitutionally censoring, the content on TV 25, YOUR LOCAL GOVERNMENT is perverting, through overtly criminal behavior, AMERICAN LAW. In my opinion that makes them overtly unAmerican criminal traders, and they should be appropriately prosecuted and punished. They have willfully and deliberately perpetrated a theft of constitutionally protected American freedom and that is nothing short of a high crime.

You are very wrong regarding sponsorships being illegal. Many public access stations across NJ and the country use these as a way to make money to keep the station operational.

Yes, it may be a hazy line between an advertisement and a sponsorship, but that line is recognized and enforced by the FCC and Patriot Media.

This "well everyone else's breaking the law" is the favorite excuse of the Mendham government's. The law defines a "not to exceed maximum" price to be charged for public documents, and the petty governments throughout New Jersey presume that maximum is the recommended price, or the price the law intents townships charge.

The logic of "everyone else is doing it" is immature, and shows no respect for the reasonable principles involved. As my experience has demonstrated, the courts of New Jersey are corrupt, and the law even the Supreme Court has written is not being enforced. Direct sponsorships is clearly purchased influence that offends the very core purpose of "public access television". A First Amendment Free-speech Voice in public forums, like public-access-television, cannot be sold at a price. A public "soap box" must be equally accessible all, or accessible to none... that's what the law, and the American Constitution Demands!

The Board continued the discussion from the previous meeting on the organization of the Station's management structure. Steve Mountain distributed a draft job description for a Station Coordinator position. It was recommended that the Board initiate a public relations effort to publicize the Borough's integration into the station and the need for assistance with the Station management. Steve Mountain agreed to work with Ralph Blakeslee on a newsrelease that could also be modified for posting on the community's websites and TV-25.

Further discussion ensued on the need for follow through on the acquisition of equipment and program development to support the station's further growth. Steve Mountain agreed to work with Gail Mooney and Tom Kelly on the equipment acquisition. A suggestion was made that the station sponsor a program development contest as a means to stimulate program ideas and interest in the station. Gail Mooney agreed to develop guidelines for the contest for the Board's consideration at the next meeting.

The Board discussed the integration of Mendham Borough into the bulletin board and the need for further guidelines on bulletin board postings. Steve Mountain agreed to work with Phyllis Florek, Dave Murphy and Ralph Blakeslee on this project. It was agreed that this could be completed prior to the next Board meeting.

The Board discussed the 2007 meeting schedule. It was agreed that meetings would be held in March and April. A decision would be made at the April meeting as to whether meetings will continue on a monthly basis or every month. It was also agreed that the meetings would take place on the last Thursday of the month. The next meeting would be Thursday, March 29 at a 8 a.m.

The meeting of the Mendham TV-25 Executive Board to order at 8:00 a.m. on March 29, 2007

Steve Mountain presented the minutes from the February 9th meeting. The minutes were
accepted unanimously by the Board.

Steve Mountain provided an update on the efforts to develop an underwriting policy for the station. He advised that he has assembled policies from a number of other stations and that he will be utilizing these policies to develop a draft policy for TV-25. The draft should be ready for review at the April meeting. A brief discussion ensued. It was agreed that all references to raising funds in the community should be characterized as underwriting.

Steve Mountain provided an update on the efforts to integrate the Borough into the TV-25 bulletin board. He advised that Ralph Blakeslee is working with him to provide content for the Borough. Once this content is fully assembled the bulletin board will be completely overhauled to create a clear distinction between Township and Borough activities.

The Board engaged in a discussion of the station manager position. It was reported that the Borough and Township newsletters will be carrying an article advertising the need for a station manager. The Board agreed that if the article does not result in volunteers coming forward to fill the position, a discussion should take place at the April meeting on making this position a paid position.

Steve Mountain provided an update on the acquisition of equipment for the station. He reported that a phone and fax were purchased in the past month. He also indicated that three new dvd decks had been purchased and that these decks will be installed in the next few weeks when the controllers for the decks arrive.

Gail Mooney presented the draft of proposed rules for the video contest. The Board discussed the rules and suggested several changes which Gail agreed to incorporate into the document. Gail also agreed to work with Geri Bain on an entry form. Steve Mountain asked the Board to think about potential judges and sponsors for the contest and to come to the next meeting prepared to discuss this area of the contest set-up. Steve also agreed to have the Township's risk manager review the contest for liability coverage.

Buzzy Thomas advised that the High School has initiated a class on video production. He provided the contacts for the class and suggested that the Board approach the school about partnering with the school in this area in the future. Steve Mountain agreed to follow-up with the school prior to the next meeting and he will report on the meeting at the Board's April meeting.

Tom Kelly reported on a contact he made at the Black Mariah Film Festival. This contact has a library of short films which he would be willing to share with TV-25 for airing in the future. The Board agreed that this would be a good idea and encouraged Tom to follow-up on this lead. It was also suggested that the Board reach out to the manager of the Black River Film Festival in Chester to see if they would be agreeable to sharing their films with the station.

Steve Mountain reported that an individual had contacted him about volunteering. The individual has a background in film production. The Board agreed that it would be a good idea to follow-up with this contact to see how he might be able to lend his expertise to the station.

Gail Mooney reminded the Board of her interest in developing an interview program. After a short discussion it was agreed that a casting call should be advertised for individuals from the community who might be interested in volunteering for such a position. Steve Mountain agreed to draft the language for this promotion and to distribute it to the local media outlets once the language had been agreed upon by the Board.

Steve Mountain advised that the next Board meeting would be Thursday, April 26 at a 8 a.m.

The meeting of the Mendham TV-25 Executive Board to order at 8:00 a.m. on April 26,2007

Steve Mountain presented the minutes from the March 29 meeting. The minutes were accepted unanimously by the Board.

Steve Mountain presented a draft underwriting policy for discussion by the Board. He advised that the draft was assembled from a variety of policies collected from other public access stations. A brief discussion ensued. It was suggested that any forms or agreements referenced in the policy be attached with the policy document. The Board agreed to complete its review of the policy document over the next week and to forward suggested changes to Steve prior to May 4, 2007. Steve agreed to revise the draft accordingly and to circulate the final draft for review prior to the next Board meeting.

Ralph Blakeslee provided an update on the efforts to integrate the Borough into the TV-25 bulletin board. He advised that the Borough's management intern is presently assembling the Borough content and will prepared in May to turn the information to the Station's technical assistant for integration into the Bulletin Board. It was agreed that the Township slides should also be reviewed and the overall format adjusted at the time of the integration to clearly distinguish Township and Borough information. Steve indicated that he hoped to have a station manager in place by that time to help with the integration effort.

The Board engaged in a discussion of the station manager position. Per the Board's direction, both Borough and Township newsletters carried articles advertising the need fora station manager. The articles thus far only yielded calls from individuals seeking compensation for the service. It was agreed that given the scope of job responsibilities the likelihood of finding a competent volunteer to fill these duties was slim. Steve Mountain was directed to set up interviews for interested candidates for a paid position and to report on the results of those interviews at the May meeting.

Steve Mountain provided an update on the casting call for the community talk show program. He advised that he has received all the comments on the press release and will be sending the revised release out to the local newspapers, posting on the web site and on TV-25 in the next week.

Geri Bain advised that She and Gail Mooney will be meeting in the next few weeks to develop rules for the video contest discussed at the March meeting. She indicated that they will provide a draft of the proposed contest rules at the May meeting. It was agreed that the Board should target the release of the contest information for June with a deadline for submittals in the fall.

The Board briefly discussed under old business the need to follow-up with the High School to discuss coordination with their new video production class. Ralph Blakeslee agreed to contact lhe~High~Scho6l principaTtd'sd. up" the"meeting......

Tom Kelly reported he did some follow-up checking on the local Film Festivals in an effort to obtain videos. He indicated that their was a willingness to share videos, however, clearance needed to be obtained from the producers to allow for re-broadcast of the videos.
Steve Mountain reported that an individual had contacted him about summer employment Steve advised he would be meeting with the individual to discuss the individual's interest and the available opportunities.

Steve Mountain reported that Patriot Media is in the process of being sold to Comcast. Steve advised that this sale should have no material change on TV-25 since Comcast will be required to follow the terms of the Patriot Media franchise agreement

Steve Mountain advised that the next Board meeting would be Thursday, May 17 at a 8 a.m. With no further business to discuss, the meeting was adjourned at 9:05 a.m.

Filmmakers sought for acclaimCable channel hosts contest for best local videos

MENDHAM – Public access TV station, Mendham TV 25, is looking for the next Steven Spielberg among its most creative residents.

To that end, the station will accept videos as part of a contest with the winning entry aired on the channel.

The station, which was created in the fall of 2006, can be viewed through Patriot Media on channel 25. Although it is mainly used to alert residents to upcoming events, those on the board of TV-25 are hoping to expand programming which will highlight achievement and interests of the community.

“We really want to raise awareness about the station so that we can eventually develop programming,” said Township Administrator Steve Mountain, who also sits on the board of the television station. “This contest in an opportunity for local filmmakers to air their work.”

Nov. 1 Deadline

Entrees to the video contest will be accepted until Nov. 1. It is open to all residents of Mendham Township, Mendham Borough, Chester Township and Chester Borough.

Video entries, which must be submitted in VHS or DVD formats, can be anywhere from five minutes to one hour in length. All entries must be the original creation of the entrant and content cannot be taken from other media, unless written permission from the creator is received.

Any entry which features footage of minors must be accompanied by written consent by the minor’s parent or guardian, according to the rules. All entries will become the property of Mendham TV-25 and will not be returned.

Contestants may submit one entry.

“It is exciting to see a self-funded initiative like TV-25 take off in our communities,” said Daryl Brewster, chairman of the Mendham TV-25 Board of Directors. “With all of the talent in Mendhams, I can’t wait to see the video entries.”

TV-25 Station Manager Nanci Kappel said there are no strict thematic rules so that residents can be as creative as possible.

“We are looking for a wide variety of entries and hoping that a lot of residents will participate,” Kappel said.

Mountain also said that because the station is so new and this is the first year of the contest, members of the board wanted to try and reach as many people in the community as possible.

“The parameters were left open on purpose,” Mountain said. “We didn’t want to target just one audience or just one genre. We are hoping for more involvement and a lot of submittals.”

Participants in the contest will be sorted and judged in three separate age groups, including pre-high school students, high school students, and adults. The grand prize winner, who submits the best overall video, will have their film aired on Mendham TV-25 in a special broadcast.

Five of 10 first prizewinners in each age group will win TV-25 bumper stickers.

Mountain said there will be other prizes awarded to winners of the contest.

“We will have a variety of prizes,” Mountain said. “Hopefully we can get some sponsored prizes by local businesses.”

Mountain said channel-25, which is privately funded, will soon expand and involve as many residents as possible.

“The community and the township have been very supportive,” Mountain said. “It is a natural progression to develop a partnership with the (area) schools down the road.”

Gail Mooney, associate member of the Mendham TV-25 steering committee, said the station’s main mission is to “create a viable public access station with local information and/or a platform to show the community, their people, and the achievements of people in the community.”

“This is an exciting time for Mendham TV-25,” said Geri Bain, member of the Mendham TV Executive Board. “The station is undergoing a redesign and is slated to re-launch by the end of the year with a new look and scheduled programming. We are providing opportunities for students to have their work broadcast and are looking to work with the high school to this end.”

Additionally, Mooney said the channel is searching a Mendham anchor person.

“We are also looking to produce a regular show which will be an interview show,” Mooney said. “We will be casting for a local anchor person who will interview various members of the community and the show will air once a week.”

Mooney said the station is moving forward, working to provide “relevant community information, education and entertainment,” without the use of any tax dollars.

The station startup cost was funded by Patriot Cable, while ongoing costs will be covered by sponsorships and fundraising activities, Kappel said. This “model” has already been used successfully in more than 100 communities, including Bernardsville and Summit.

“People talk about improved cooperation between the township and the borough; TV-25 does it,” said Brewster. “TV-25 has become a part of our communities. New programs and videos will make it even better.”

TV25 Film / Video Contest



Contest is open to legal residents of Mendham Township , Mendham Borough, Chester Township and Chester Borough, Morris County, New Jersey.



1. TO ENTER: Contest begins August 1, 2007 and ends November 1, 2007 (“Entry Period”). You may enter the “Mendham TV-25 Video Contest” (“Contest”) by completing the entry form found on the website at www.mendhamtownship.org and submit along with your video to: Mendham-Chester TV-25 Film/Video Contest, P.O. Box 520 , Brookside , New Jersey 07926 . Entries must only be submitted via U. S. Mail or any other conventional mail delivery service and must be postmarked by November 1, 2007. Video entries must be submitted in VHS or DVD formats and include a completed entry form which includes name, address, zip code, daytime telephone number, email address and date of birth. DVD entries may not contain a menu; only the submission to be broadcast may be on the DVD submitted. Your tape/ DVD must be clearly and legibly labeled with the title, your contact information (name, address, and phone number), and running time. The entry form must also state the length of video (which can be between five (5) minutes and one (1) hour in length).

2. CONDITIONS: Entries will be void if they are incomplete, late, lost, damaged, received as postage due mail or are not able to be viewed due to technical error. By entering, entrants acknowledge compliance with these official rules including all eligibility requirements. All entries become the property of the Mendham TV-25 (“Sponsor”) and will not be returned.



All video entries must be the original creation of the entrant. Content cannot be taken from other videos, films or photographs, etc., unless written permission from the creator is received, or the content is in the public domain. Written or video permission must be obtained from each person appearing in the videos, photographs, etc., unless footage is taken from a public event. To air footage of minors, written consent must be received from the minor’s parent or guardian.



Any music used in a submission must be original or in the public domain, unless written copyright approval is obtained from the creator/copyright holder. Note that downloading music from an online music purchasing service, such as iTunes, or ripping music from a purchased CD, does NOT constitute copyright permission. Royalty-free music may be used if purchased from a company (many of which are available online).



Videos submitted cannot be commercial in nature or endorsements of any product or service. Submittals must be received in a “ready-to-air” condition, meaning credits or titles must be included in the submission if they are to be part of the film. TV-25 will only broadcast “complete” works that are suitable and ready to be aired in the sole discretion of the judges.



The video must not have been previously submitted, distributed, aired or have won any other award in any other competition. All entrants will be required to sign an affidavit verifying the originality of the video and compliance with contest rules. Entry cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party personal or proprietary rights. Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to depictions of buildings, trademarks or logos) must be able to provide legal releases for such use including Sponsor’s use of such entry, in a form satisfactory to judges. Entry must be in keeping with Sponsor’s image and may not be offensive, as determined by judges in their sole discretion. Entrants grant TV-25 permission to air their submittals on TV-25 for an unlimited number of showings.



3. CONTEST GUIDELINES: Participants must create an original video. Entries will be sorted and judged into three separate age groups; 1) pre-high school students, 2) high school students, and 3) adults. Limit one entry per person. Subsequent entries submitted by a single entrant are void.



4. PRIZES: One (1) Grand Prize: Grand Prize winner who submits the best overall video will have their film aired on Mendham TV-25 in a special broadcast, schedule to be determined at a later date, plus a gift certificate to a local business. Grand Prize winner will be required to submit the original master copy of video for on-air use. Ten (10) First Prize (5 prizes awarded in each age group): will receive a framed certificate, plus a gift certificate to a local business Winners will be determined on or about December 1, 2007.



5. JUDGING: Entries will be judged by residents of the four communities of Mendham Township, Mendham Borough, Chester Township, and Chester Borough, based on the following criteria for both age groups: creative concept (25%), technical ability (25%), sound (25%), dialogue (25%). In the event of a tie, the entries involved will be re-judged by an additional judge who will serve as a tiebreaker and who will evaluate entries according to criteria listed above. Video entries must be between five (5) minutes and one (1) hour long and have a title.



Judges reserve the right not to award the Grand Prize if it determines that no entry is qualified. Winners will be notified by e-mail and may be required to complete Affidavit of Eligibility/Liability/Publicity Release (where legal) and W9 Taxpayer Identification Form. These documents must be signed, notarized and returned within seven (7) days of issuance of notification. Failure to comply will result in disqualification and the prize will be forfeited and may be awarded to another winner. Taxes, if any, are the sole responsibility of the winners. No transfer or substitution of prizes permitted.



Winners agree that the sponsor, and their agencies and their employees shall not be liable for injury, loss or damage of any kind resulting from participation in this promotion or from the acceptance or use of the prizes awarded.



6. ELIGIBILITY: Contest open to legal residents of Mendham Township , Mendham Borough, Chester Township and Chester Borough, Morris County, New Jersey. A minor (for these purposes, a person under 18 years of age) submitting an entry should receive his/her parent/legal guardian’s permission and include his/her parent’s/legal guardian’s name and daytime telephone number on the official entry form. If a prize is won by a minor, the prize shall be awarded to the minor’s parent or guardian who must execute the required documentation on the minor’s behalf. Contest is subject to all applicable federal, state and local laws and regulations.



Entries received prior to or after Entry Period are void. By accepting the prize, winners consent to the use of their name, video entry, biographical information, photographs and or likenesses for advertising and publicity purposes without additional compensation (except where prohibited) by Sponsor for editorial purposes concerning this contest or succeeding contests and for editorial publicity, special events and advertising purposes in connection with promoting TV-25, its products, its Web site www.mendhamtownship.org and/or this contest or succeeding contests.



By submitting an entry in connection herewith, Entrant unconditionally assigns and transfers to Sponsor all rights, title, interest and claim, which it now has or may in the future have to entries (including, without limitation, the submitted video), whether acceptable or not regardless of the form they take, or any element(s) thereof including, without limitation, the copyright therein and further grants the Sponsor the right to use, publish, exploit and/or modify any entry and/or video submitted in connection herewith in any manner it wishes. Sponsor reserves the right to modify video or video titles and publish or advertise the video without approval, acknowledgement or compensation unless prohibited by law. By entering, entrants agree to defend, release and hold harmless the sponsor and their agents from and against any claims, action and/or liability for injury, loss or damage of any kind resulting from participating in this promotion (including in connection with the use and/or exploitation of the submitted video) or from the acceptance or use of prize awarded. Sponsor reserves the right to verify eligibility qualifications of the winner. US law governs these contest rules.



7. RELEASE: Neither Sponsor, their affiliates, subsidiaries, divisions, advertising and promotion agencies, and their respective officers, directors, shareholders and employees (collectively “Releasees”) nor any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in this Contest, or for any injury to person or property, including but not limited to video equipment, arising from the entrant’s participation in this Contest or for the use or misuse of any prize won. Releasees are not responsible for lost, late, illegible or misdirected entries or mail.



8.ADDITIONAL RESTRICTIONS: Caution: Any attempt by an entrant or any other individual to deliberately damage any online service or web site, tamper with the judging process, or otherwise undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Contest is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes beyond the control of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Contest and/or award the prizes from among all eligible, non-suspect entries received as of the date of the termination, as Sponsor determines in its sole discretion. Entries not complying with all rules are subject to disqualification.



No correspondence regarding entries will be entered into with entrants other than the potential Grand Prize winner. By entering, each entrant licenses all rights to the content of his/her entry and the ideas/concepts embodied therein. Sponsor shall have the right to modify, use, assign or dispose of such entries however they see fit without approval of entrants or any third party.



Entrants grant Sponsor the right to use their names, images, likenesses, photographs, voices and biographical materials, and video submissions, for advertising, publicity and promotion purposes including posting the videos or screen names online for any purpose or on a winner’s list and other online announcements, and for sharing the videos with the media for viewing, whether TV or print, without additional compensation, unless prohibited by law. Neither entrants nor winner shall receive any compensation or credit for use of entries, other than that disclosed in these rules. Entrants agree that if selected as the Grand Prize winner, they grant Sponsor and its designees the right to film and later publish footage of the winner preparing for the premiere.
